White House's Justifications
The top government lawyer, speaking on behalf of the White House, claimed in the new filing that federal agents have often been âmenaced and attackedâ in Chicago and the outlying area of Broadview.

The former president has earlier deployed state guard forces to Chicago, Illinois and Portland, Oregon, after earlier activations to Los Angeles, California, Memphis, and the nation's capital.

At the core of the dispute is the government's invocation of a federal statute authorizing the commander-in-chief to take control of the state guard only in cases of insurrection or when âincapable with the standard military to enforce the laws of the United Statesâ.

Previously, the White House federalized 300 members of the Illinois military reserve and commanded additional Texas-based troops into the state.
As city officials denounced the decision, the president escalated his rhetoric, demanding the apprehension of Chicagoâs mayor and the governor of Illinois, the two Democratic officials, alleging them of neglecting to protect ICE personnel.
State authorities and Chicago jointly sued the government to halt the sending.
On 9 October, the presiding federal judge, a Biden appointee, delivered a temporary injunction blocking the command.

At the same time in Chicago, at least 11 people were detained outside the ICE facility in Broadview following heated confrontations between local police and activists.
